Rubbish Removal Soho Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Soho provides rubbish removal and waste collection services to domestic and commercial customers within our service area. By booking a collection, requesting a quotation or allowing our team to commence work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

Customer means any individual, business or organisation that books or receives rubbish removal or waste collection services from Rubbish Removal Soho.

Services means any rubbish removal, waste collection, clearance, loading, transport, or related activity provided by Rubbish Removal Soho.

Waste means any items, materials, rubbish or refuse to be collected and removed by Rubbish Removal Soho as part of the Services, excluding any items classified as prohibited or hazardous under these terms or applicable law.

Booking means a confirmed request for Services made by the Customer and accepted by Rubbish Removal Soho.

2. Scope of Services

Rubbish Removal Soho provides on-demand and scheduled rubbish removal and waste collection services in and around the Soho area and nearby locations. The specific scope of each Service will be confirmed at the time of quoting and booking.

Unless otherwise agreed in writing, the Services include the collection, loading and transport of agreed Waste from the Customer’s premises to an authorised waste transfer station, recycling centre or disposal facility. The Services do not include specialist dismantling, structural work, cleaning, gardening, pest control or any other services not expressly agreed at the time of booking.

Rubbish Removal Soho reserves the right to refuse to provide Services where access is unsafe, where the Waste is not as described by the Customer, or where the Waste includes prohibited or hazardous materials that we are not licensed or insured to handle.

3. Booking Process

Customers may request a quotation or book Services by telephone, email or online contact form. The Customer is responsible for providing accurate and complete information, including the type and approximate volume of Waste, the location, access details and any relevant restrictions such as parking or building regulations.

Any quote provided before our arrival is an estimate only and may be revised once our team has inspected the Waste on site. The final price will depend on the actual volume, weight and nature of the Waste, as well as the time and resources required to complete the Services safely.

A Booking is only confirmed when Rubbish Removal Soho has accepted the request, agreed a date and time window, and provided confirmation to the Customer. We may request additional information or photographs of the Waste before confirming a Booking.

Rubbish Removal Soho will use reasonable efforts to arrive within the agreed time window. However, all times are estimates and may be subject to change due to traffic, weather, operational delays or other circumstances beyond our control. Where possible, we will notify the Customer of any significant delay or need to re-arrange a Booking.

4. Customer Obligations

The Customer must ensure that suitable access is available at the premises on the agreed date and time of the Booking. This includes arranging parking or permits where necessary, informing us of any height or access restrictions, and ensuring that access routes are clear and safe for our team.

The Customer must be present at the start and end of the Service unless otherwise agreed in advance. In the Customer’s absence, instructions left with a third party or representative will be treated as instructions from the Customer.

The Customer is responsible for ensuring that the Waste presented for collection is accurately described, separated where required, and does not include any prohibited items. The Customer must notify us in advance if any items require special handling, such as electrical equipment, fridges, freezers, mattresses, or bulky items located in difficult areas such as lofts or basements.

Where the Customer fails to provide access, parking, or accurate information, Rubbish Removal Soho may charge a waiting fee, an additional access fee, or a call-out charge where the Service cannot be completed.

5. Pricing and Payment Terms

Prices for Services are generally based on the volume and type of Waste, measured in cubic yards or similar units, as well as any additional labour or access requirements. A minimum load charge may apply. Any such charges will be explained at the time of quotation to the extent possible.

Unless otherwise agreed, payment is due immediately on completion of the Service. We may accept payment by cash, card or bank transfer. Rubbish Removal Soho reserves the right to require a deposit or full payment in advance, particularly for larger or commercial bookings.

If payment is not received when due, Rubbish Removal Soho may charge interest on the outstanding amount at the statutory rate applicable in the UK, calculated daily, until payment is received in full. We may also suspend or refuse further Services until all overdue amounts have been paid.

All prices are quoted exclusive of VAT unless clearly stated otherwise. Where applicable, VAT will be added at the prevailing rate and itemised on the invoice or receipt.

6. Cancellations and Amendments

The Customer may cancel or amend a Booking by contacting Rubbish Removal Soho during normal business hours. Cancellations or amendments received at least 24 hours before the scheduled arrival time will normally be accepted without charge.

Where a Booking is cancelled with less than 24 hours’ notice, or where we arrive on site and are unable to carry out the Service due to the Customer’s act or omission, Rubbish Removal Soho reserves the right to charge a cancellation or call-out fee to cover our reasonable costs.

If the Customer wishes to significantly change the nature or volume of Waste to be collected, Rubbish Removal Soho may need to re-quote and reschedule the Booking. We will inform the Customer if any additional charges or delays apply before continuing with the Service.

Rubbish Removal Soho may cancel or reschedule a Booking where necessary due to staff illness, vehicle breakdown, severe weather, safety concerns or other circumstances beyond our reasonable control. In such cases, we will endeavour to provide as much notice as reasonably possible and to agree an alternative date and time with the Customer. We will not be liable for any indirect loss arising from such cancellation or rescheduling.

7. Waste Types and Prohibited Items

Rubbish Removal Soho will collect most common household and commercial waste, including general rubbish, furniture, appliances, packaging, small construction waste and garden waste, subject to our capacity and licensing.

Certain materials are prohibited or may require specialist handling, permits or disposal routes. These include, but are not limited to, asbestos, clinical or medical waste, chemicals, solvents, oils, paint in liquid form, gas cylinders, explosives, radioactive materials, biological waste, and any other substances classified as hazardous or dangerous under UK law or guidance.

If prohibited or hazardous materials are identified at the time of collection, our team may refuse to handle them, adjust the quote to reflect specialist disposal charges where we are licensed to handle them, or terminate the Service if it cannot proceed safely or lawfully. Any costs incurred as a result of undisclosed hazardous waste may be charged to the Customer.

The Customer warrants that all Waste presented for collection is free from dangerous or illegal items and that Rubbish Removal Soho will not incur any liability as a result of reliance on the Customer’s description and representation of the Waste.

8. Title to Waste and Disposal

Title and responsibility for the Waste transfers from the Customer to Rubbish Removal Soho once the Waste is loaded onto our vehicle and full payment is received, subject to these Terms and Conditions.

Rubbish Removal Soho will transport the Waste only to authorised facilities such as licensed waste transfer stations, recycling centres and disposal sites. We are committed to responsible waste management and will endeavour to divert Waste from landfill where practicable, in accordance with applicable UK waste regulations.

We may separate or sort Waste after collection to maximise recycling and recovery. The Customer acknowledges that once the Waste has been collected, they have no further claim on any items, and Rubbish Removal Soho has full discretion regarding its handling within the law.

9. Liability and Limitations

Rubbish Removal Soho will perform the Services with reasonable care and skill. Our liability for any loss or damage suffered by the Customer in connection with the Services is limited as set out in this section.

Rubbish Removal Soho will not be liable for any pre-existing damage at the premises or to items that are fragile, poorly installed, or not reasonably suitable for moving. The Customer should remove or protect any items of special value or sensitivity before our team begins work.

If any damage is caused directly by our negligence while providing the Services, the Customer must notify us as soon as reasonably practicable and in any event within 48 hours of completion of the Service. Rubbish Removal Soho may request evidence, including photographs, and an opportunity to inspect the damage before any remedial action is agreed.

To the maximum extent permitted by law, Rubbish Removal Soho will not be liable for any indirect, consequential or economic loss, including loss of profit, revenue, opportunity or reputation, arising out of or in connection with the Services or these Terms and Conditions.

Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully excluded under UK law.

10. Insurance

Rubbish Removal Soho holds public liability insurance appropriate for the nature of our rubbish removal and waste collection activities. Details of our insurance cover are available on request.

The Customer is responsible for arranging any insurance they consider necessary for their own property, premises and belongings, including during the performance of the Services.

11. Access, Safety and Conduct

The Customer must ensure that the working area is safe and that our team is not exposed to unnecessary risks. We may refuse to carry out or continue the Service if conditions are unsafe, including due to aggressive behaviour, the presence of hazardous materials, or structural instability.

Rubbish Removal Soho expects courteous and respectful conduct from both our staff and Customers. We reserve the right to withdraw our team and terminate the Service immediately if our staff are subject to abuse, harassment, discrimination or threats. In such circumstances, the Customer may still be charged for any work already completed or costs incurred.

12. Data Protection and Privacy

Rubbish Removal Soho collects and processes personal data such as names, contact details, addresses and payment information solely for the purpose of managing Bookings, providing Services and administering our customer accounts.

We will handle personal data in accordance with applicable UK data protection laws and will not sell or knowingly disclose personal data to third parties except where required for the performance of the Services, for legal or regulatory reasons, or with the Customer’s consent.

13. Complaints

If the Customer is dissatisfied with any aspect of the Services, they should contact Rubbish Removal Soho as soon as possible, providing full details of the issue, the Booking reference, and any relevant evidence. We will investigate the complaint and aim to respond within a reasonable timeframe.

Where a complaint is upheld, Rubbish Removal Soho may, at our discretion, offer a remedy such as a partial refund, a re-visit, or an alternative resolution. Any such remedy will be in full and final settlement of the complaint in respect of the specific Service concerned.

14. Changes to Terms and Conditions

Rubbish Removal Soho may update or amend these Terms and Conditions from time to time to reflect changes in our services, business practices or legal requirements. The latest version will apply to all new Bookings and will be made available on request.

Where changes are made that materially affect existing Bookings, we will take reasonable steps to inform affected Customers in advance. Continuing to use our Services after such notification will constitute acceptance of the updated Terms and Conditions.

15. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Rubbish Removal Soho.

16. Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of Booking issued by Rubbish Removal Soho, constitute the entire agreement between the parties in relation to the Services. They supersede any prior discussions, correspondence or understandings between the Customer and Rubbish Removal Soho relating to the subject matter of the Services.

No variation of these Terms and Conditions shall be effective unless agreed in writing by Rubbish Removal Soho.
